How Banks County Fair Market Value Becomes Assessed Value

January 1 Property status and annual value are considered for the tax year.
Market Review Appraisal staff analyze sales and market conditions by neighborhood, type and use.
100% FMV Property is appraised at estimated fair market value.
40% Assessment Standard Georgia assessed value is 40% of fair market value.
Tax Exemptions are applied and millage determines the resulting ad valorem tax.
Example: a property appraised at $300,000 generally has a gross assessed value of $120,000 before applicable exemptions or special valuation programs.
The Board of Tax Assessors does not set the millage rate. County, school and applicable municipal governing bodies establish their respective tax rates.

How to Appeal a Banks County Property Assessment

Banks County says Annual Assessment Notices are normally sent near the end of May. The taxpayer has 45 days from the date on the notice to appeal.

Value Argue that the county’s appraised value does not reflect fair market value.
Uniformity Argue that the assessment is inconsistent with comparable taxable property.
Other grounds Taxability, exemption denial, breach of covenant or denial of covenant can also be appealed.
Read the exact Appeal Deadline printed on your notice. Do not calculate from when you happened to open the envelope.
Identify the parcel. Include the Parcel Identification Number and property address.
State what you are appealing. Identify value, uniformity, taxability, exemption or covenant issue.
Select your appeal route. Banks County identifies Board of Equalization, Hearing Officer or Arbitration as the principal initial election choices where applicable.
Attach useful evidence. Comparable sales, photographs, appraisal information or evidence of factual property errors can strengthen a value appeal.
File correctly. Banks County says appeals must be hand-delivered or postmarked by the U.S. Postal Service by the appeal deadline.
Banks County says it does not accept emailed property appeals. A faxed appeal must be followed by the original or it is not considered valid.

What Happens After You File the Appeal?

Banks County Homestead Exemption

Homestead exemptions are not automatic. Banks County says the applicant’s name must appear on the deed and the applicant must own, occupy and claim the property as the legal residence on January 1 for the applicable tax year.

File anytime Applications can be submitted during the year.
April 1 cutoff The application must be filed by April 1 to apply to that tax year.
Additional exemptions Certain elderly homeowners and other qualifying taxpayers can receive additional local/state benefits.
2026 regular deadline has passed. An application filed after April 1 is generally processed for a later tax year rather than creating the ordinary 2026 benefit.
Banks County says a taxpayer may need proof of Georgia residency/citizenship or lawful immigration status and must reapply when certain ownership/name changes occur because of marriage, death or divorce.

Conservation Use Valuation Assessment

CUVA for Banks County Agricultural and Timber Land

Qualifying agricultural land, timberland and environmentally sensitive land can receive Conservation Use treatment under Georgia law.

40% of current-use value CUVA property is assessed using current-use value instead of unrestricted fair-market value.
10-year covenant The owner commits the property to qualifying use for a ten-year period.
Breach can be expensive Banks County warns that covenant breach can require repayment equal to twice the tax savings accumulated over the covenant period up to the breach.
Normal application period: January 1 through April 1. Banks County also states that a CUVA application can be filed during the 45-day assessment-notice appeal period in qualifying circumstances.
For applications involving 10 acres or less, Banks County says substantial proof of bona fide agricultural use is required. A residence and two acres are excluded from new/renewal CUVA covenants under the rule described by the county.

Banks County also describes a separate Georgia preferential-assessment program for bona fide agricultural property.

30% of fair market value Qualifying preferential agricultural property is assessed at 30% rather than the ordinary 40%.
Eligible production Agriculture, horticulture, forestry, dairy, livestock, poultry, apiary and other bona fide farm production can qualify.
10-year use commitment The property must remain in qualifying current use for the applicable period.

Do You Still Have to Pay if the Property Is Under Appeal?

Yes. Filing an appraisal appeal does not simply postpone the entire property-tax obligation.

Temporary value Banks County says the temporary billing value is the lesser of last year’s value or 85% of the current year’s original Notice value.
Pay by due date The county says at least the appeal amount must be paid by the normal tax deadline.
Final adjustment After the appeal closes, the Tax Commissioner determines whether an additional bill or credit/refund is required.
Banks County says the Assessor cannot extend the tax-payment deadline simply because the assessment is being appealed.

Sold the property during the year? The Tax Commissioner does not prorate county taxes between buyer and seller. Closing documents normally allocate the financial responsibility, but property taxes attach to the property and the current owner should verify that they are paid.
